These Terms and Conditions set out the basis on which Rubbish Collection Bloomsbury provides waste and rubbish collection services to domestic and commercial customers. By placing a booking, you agree that these Terms and Conditions form the entire agreement between you and us for the provision of our services.

1. Definitions and Interpretation

In these Terms and Conditions, the following expressions have the meanings set out below:

Service means any rubbish collection, waste removal, clearance, loading, transportation or related services we provide.

2. Scope of Services

We provide rubbish and waste collection services within our designated service area, including the collection, loading and transportation of waste from the Site to an authorised waste transfer or disposal facility. The exact Service, including the type and volume of waste to be collected, will be set out and agreed during the booking process.

We reserve the right to decline any Service request at our discretion, including where the waste is unsuitable, hazardous without prior agreement, or exceeds safely manageable volumes or weights.

3. Booking Process

3.1 You may request a booking by telephone, email or through any online booking facility we provide. You must provide accurate and complete information about the Site, access arrangements, the type and approximate quantity of waste, and any relevant safety or access issues.

3.2 We may provide an estimated price based on the information you supply. This estimate may be subject to change if, on arrival at the Site, the actual waste type, volume or access conditions differ from those described in your booking request.

3.3 A booking is only confirmed when we accept your request and provide a confirmation by verbal agreement, written message or other clear acknowledgement. At that point, a binding Contract is formed, subject to these Terms and Conditions.

3.4 You are responsible for ensuring that someone with authority to grant access and approve the Service is present at the agreed date and time, unless we agree in advance that attendance is not required.

4. Access and Site Requirements

4.1 You must ensure that we have safe, reasonable and unobstructed access to the Site and to the waste to be collected at the agreed time. This includes making sure that any gates, doors, parking spaces, lifts, stairwells, entrances, driveways and internal routes are clear and available for our use.

4.2 If parking permits, entry codes or special access arrangements are required, you must obtain and provide these in advance. Any charges, fines or penalties arising from parking or access issues caused by incomplete or inaccurate information from you may be added to your invoice.

4.3 If we are unable to carry out the Service or we incur additional time or costs due to lack of access, incorrect information, or unsafe conditions at the Site, we may charge a failed visit fee or adjust the price to reflect the additional time and labour.

5. Waste Type and Prohibited Items

5.1 You must clearly inform us of the type of waste to be collected. We will only collect waste that complies with applicable waste legislation and which we are authorised and equipped to handle.

5.2 Unless expressly agreed in advance, our standard Service does not include collection of hazardous or specialist waste such as chemicals, oils, asbestos, clinical waste, gas cylinders, certain electrical equipment or other materials classified as hazardous under UK waste regulations.

5.3 If hazardous or prohibited items are discovered during the Service which were not disclosed, we may refuse to remove them, adjust the price, or terminate the Service. You will remain responsible for any such items and for ensuring their lawful disposal.

5.4 You confirm that you are the owner of the waste or are otherwise authorised by the owner to arrange for its removal and disposal. By presenting items as waste, you give us permission to remove and dispose of them as we deem appropriate within regulatory requirements.

6. Pricing and Payment Terms

6.1 Prices for our rubbish collection services are typically based on factors including the type and volume of waste, labour time, access conditions, weight restrictions and disposal fees. Any estimate provided before we attend the Site is indicative only and may be revised once we have inspected the waste.

6.2 We will confirm the final price with you before commencing the Service wherever practicable. If you do not accept any revised price, you may decline the Service, but a call-out or cancellation fee may be charged if we have already attended the Site.

6.3 Payment is due in full upon completion of the Service, unless we have agreed alternative terms in writing in advance. We may require payment in advance for certain bookings or from particular customers.

6.4 We accept payment by commonly used methods such as debit card, credit card, bank transfer or cash, subject to the options we make available at the time of booking or on completion of the Service.

6.5 Where credit terms are agreed for business customers, invoices must be paid in full within the period stated on the invoice. We reserve the right to charge interest on overdue amounts in accordance with applicable UK law and to recover any reasonable costs incurred in seeking payment.

7. Cancellations and Changes

7.1 You may cancel or amend your booking by contacting us directly. To avoid charges, you must provide at least 24 hours notice prior to the scheduled Service time, or such other notice period as we may specify at the time of booking.

7.2 If you cancel or amend your booking with less than the required notice, we may charge a cancellation fee to cover administrative costs and any loss of opportunity to allocate that time slot to another customer.

7.3 If we arrive at the Site and are unable to carry out the Service due to reasons within your control, including lack of access, unsafe conditions, or a substantial discrepancy between the described and actual waste, we may treat this as a late cancellation and charge a call-out or failed visit fee.

7.4 We may cancel or reschedule the Service at any time due to operational, safety, legal or other reasons outside our control. In such cases, we will aim to provide as much notice as reasonably possible and offer an alternative appointment. We will not be liable for any losses arising from such cancellation or delay beyond the fee you have paid for the affected Service.

8. Performance of the Service

8.1 We will carry out the rubbish collection Service with reasonable care and skill, in accordance with good industry practice and applicable UK waste regulations. Our personnel will act with professionalism and will endeavour to minimise disruption at the Site.

8.2 We may, at our discretion, assist with reasonable labour such as lifting, carrying and clearing items from within the property or external areas. You must ensure that the area is safe, that any fragile or valuable items are protected or removed, and that our staff are not exposed to unnecessary risk.

8.3 Times for arrival and completion are estimates and are not guaranteed, as they may be affected by traffic, weather, previous jobs, Site conditions and other factors. We will use reasonable efforts to attend within the agreed time window but will not be liable for minor delays.

9. Environmental and Waste Regulations

9.1 We are committed to carrying out waste and rubbish collection services in accordance with UK environmental and waste management regulations. We will dispose of or recycle waste only at licensed facilities or through authorised channels.

9.2 You acknowledge that once waste has been collected and loaded into our vehicle, it becomes our responsibility to manage in compliance with relevant regulations. However, you remain responsible for providing accurate information about the waste and for compliance with any site-specific rules or landlord requirements.

9.3 We may separate or sort waste to maximise recycling and recovery where practicable. The specific route and method of disposal or recycling will be determined by us, taking into account regulatory obligations and operational requirements.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be limited or excluded under applicable law.

10.2 Subject to the above, we will not be liable for any indirect, consequential or special loss, including loss of profits, loss of business, loss of data, loss of opportunity or loss of goodwill, arising out of or in connection with the Service or the Contract.

10.3 Our total liability to you in respect of all losses arising under or in connection with the Contract, whether in contract, tort, breach of statutory duty or otherwise, shall in no circumstances exceed the total amount paid or payable by you for the specific Service giving rise to the claim.

10.4 You are responsible for ensuring that any items you intend to keep are clearly separated from the waste to be removed. We cannot be held liable for the removal or disposal of items that were presented as waste or were not clearly identified as items to be retained.

10.5 You must notify us of any damage or issue you believe has been caused by us as soon as reasonably practicable and, in any event, within 48 hours of completion of the Service. We may need to inspect the Site and any alleged damage before agreeing any remedy.

11. Customer Obligations

11.1 You agree to cooperate fully with us in the performance of the Service, to provide accurate information during the booking process, and to follow any reasonable instructions or guidance we provide on the day of collection.

11.2 You are responsible for ensuring that the Site is reasonably prepared for the Service, that health and safety risks are minimised, and that children, pets and bystanders are kept away from areas where work is being carried out.

11.3 You agree not to request or require our staff to undertake any activity that is unsafe, unlawful or outside the scope of the agreed rubbish collection service.

12. Data Protection and Privacy

12.1 We will collect and process personal information about you only to the extent necessary to manage bookings, provide the Service, take payment and comply with our legal obligations.

12.2 We will take reasonable steps to keep your data secure and will not sell your personal information to third parties. We may share information with trusted partners or suppliers where necessary for the performance of the Service or compliance with law.

13. Events Beyond Our Control

13.1 We will not be in breach of the Contract or liable for any delay or failure to perform our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control. These may include severe weather, traffic incidents, industrial disputes, regulatory changes, accidents, equipment failure or other unforeseen events.

13.2 In such circumstances, we may suspend or modify the Service and will resume performance as soon as reasonably practicable. If a delay is likely to be substantial, we may cancel the affected Service and provide a refund of any payment already made for that Service.

14. Amendment of Terms

14.1 We may update or amend these Terms and Conditions from time to time. Any changes will apply to new bookings made after the revised Terms and Conditions have been made available. The version in force at the time of your booking will apply to your Contract.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

16. Severability

16.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

17. Entire Agreement

17.1 These Terms and Conditions, together with the details of your accepted booking, constitute the entire agreement between you and us in relation to the provision of rubbish collection services and supersede any prior discussions, correspondence or arrangements.
